Acceptable Use Policy

This Acceptable Use Policy ("AUP") supplements our Terms of Service and establishes the rules every business ("Client") must follow when using the Aparece platform, including website services, digital catalog, ordering system, loyalty programs, and payment processing.

Aparece is a technology platform. We are not a party to transactions between the business and its end customers. The Client is solely responsible for their products, services, pricing, deliveries, and customer support.

1. Aparece's role as a platform

Aparece provides technology tools for local businesses to establish a digital presence, manage their catalogs, receive orders, and run loyalty programs. Aparece is not a marketplace, does not sell products, and does not provide services to end consumers.

  • Aparece is not a party to, nor an intermediary in, commercial transactions between the business and its customers.
  • Aparece does not verify, guarantee, or endorse the quality, safety, legality, or availability of products or services offered by businesses.
  • Aparece is not responsible for order fulfillment, food or product quality, or customer service provided by the business.

2. Prohibited conduct

The Client agrees not to use the Aparece platform for:

Content and communication

  • Publishing illegal, fraudulent, defamatory, obscene, or violence-inciting content.
  • Spreading false or misleading information about products, services, prices, or availability.
  • Impersonating individuals, businesses, or brands.
  • Distributing malware, spam, phishing, or any malicious software.
  • Infringing on third-party intellectual property rights.

Products and services

  • Selling or promoting illegal or regulated products without proper licensing.
  • Displaying misleading prices, charging amounts different from those shown in the catalog, or applying hidden fees.
  • Offering products that do not exist or that the business cannot realistically deliver.
  • Systematically accepting orders without fulfilling them.

Orders and deliveries

  • Accepting orders with the intent of not fulfilling them or delivering products substantially different from what was offered.
  • Dishonestly manipulating order statuses (marking as delivered without actual delivery).
  • Rejecting orders on discriminatory grounds based on race, gender, sexual orientation, religion, or ethnicity.
  • Using the delivery system for illegal activities.

Payments

  • Using payment processing for fraudulent activities or money laundering.
  • Charging for products or services that are not delivered.
  • Manipulating or falsifying payment transactions.
  • Using third-party payment credentials without authorization.

Loyalty programs

  • Creating fraudulent loyalty programs or pyramid schemes.
  • Offering rewards with the intent of not fulfilling them.
  • Dishonestly manipulating points or stamps.

Technical platform use

  • Attempting to access other users' accounts, data, or functionality.
  • Reverse engineering, unauthorized scraping, or attacking platform infrastructure.
  • Using the platform to send unsolicited bulk communications.
  • Sharing portal access credentials with unauthorized individuals.

3. Business obligations

By using Aparece, the Client agrees to:

  • Maintain accurate and up-to-date information in their catalog (prices, availability, descriptions).
  • Fulfill accepted orders within the stated timeframes and conditions.
  • Operate their business in compliance with applicable Mexican laws, including health, tax, and consumer protection regulations.
  • Hold the necessary permits and licenses to operate their business and sell their products.
  • Directly handle complaints and claims from their end customers.
  • Protect their customers' personal data in accordance with the LFPDPPP.

4. Abuse reports

Anyone can report a business they believe is violating this Acceptable Use Policy. Reports can be sent to:

When submitting a report, please include:

  • Name or URL of the business in question
  • Description of the issue
  • Available evidence (screenshots, payment receipts, etc.)

Aparece will review all reports and take appropriate action, which may range from a warning to immediate service suspension.

5. Investigation and consequences

When a potential violation of this policy is identified, Aparece may:

  1. Investigate: Review the business's content, orders, and platform activity.
  2. Warn: Notify the Client of the violation and request correction within a specified timeframe.
  3. Suspend: Temporarily suspend the website, ordering system, or other features.
  4. Terminate: Permanently cancel the business's account with no obligation to refund.

In cases of fraud, illegal activity, or consumer risk, Aparece reserves the right to act immediately without prior notice.

Aparece may also report illegal activities to the appropriate authorities when deemed necessary.

6. Appeals

If a business believes the action taken against it was unjustified, it may submit a written appeal to hello@aparece.mx within 15 days of notification. Aparece will review the appeal and respond within 10 business days.

7. Limitation of liability to consumers

Aparece assumes no liability to end consumers for:

  • The quality, safety, legality, or availability of products or services offered by businesses.
  • Order fulfillment or non-fulfillment by the business.
  • Disputes between the business and its customers, including refunds, returns, or claims.
  • Damages arising from the consumption of food or other products purchased through a business using the platform.

All claims arising from a commercial transaction must be directed to the responsible business.

8. Modifications

Aparece reserves the right to modify this Acceptable Use Policy at any time. Changes will be published on this page. For substantial changes, we will notify Clients with at least 15 days' advance notice.
